Legal updates: NGT to hear Art of Living plea


New Delhi: Mint brings to you your daily dose of legal news. A look at some interesting cases coming up for hearing on Wednesday. The Supreme Court on Wednesday will hear the dispute surrounding the Sahara Group. Last month, the court allowed Sahara India to sell its properties in the country and abroad to return money to its investors. The apex court’s directive came after capital markets regulator Securities Exchange
Board of India informed the court that it has not sold any of Sahara’s properties till date. Read more .
The Delhi high court will hear a case filed by Reliance Power Ltd regarding its Sasan ultra mega power project (UMPP). Earlier, the court had allowed Reliance to increase its mining cap at a Madhya Pradesh block from 16 million metric tonnes (mmt) to 17.2 mmt based on a government order. Read more .
Reliance Power approached the high court first against the government decision to cancel allocation of Chhatrasal coal block, which was meant for Sasan UMPP. Read more .
The high court will also hear a plea seeking directions to India’s patents office to follow the over-arching Right to Information (RTI) Act in order to make its information disclosure system more transparent and easily accessible to the public. The case was filed in 2014 by a group of lawyers led by Shamnad Basheer, intellectual property rights expert and founder of IP blog SpicyIP. Read more .
The Delhi high court will hear Bt cotton seed major Mahyco Monsanto Biotech Ltd’s plea against Nuziveedu Seeds for infringing its trademark and selling seeds beyond the period of licence. Earlier, the court had restrained Nuziveedu Seeds from selling seeds manufactured after November 2015 when the licence agreement was terminated. The court had also appointed local commissioners to make an inventory of stocks available with Nuziveedu Seeds. Read more .
The Art of Living Foundation’s plea for reconstitution of an expert committee will be heard on Wednesday. The foundation moved the National Green Tribunal, seeking the reconstitution of the expert committee to examine the impact of the World Culture Festival held in March on the Yamuna floodplains.
AOL has alleged that the present committee arrived at an arbitrary figure of Rs.120 crore based on a brief “visual assessment, without following any specific procedure” and called for a free and fair assessment under a new panel. Read more .
